Vista Data Services, LLC (“Vista Data”) respects the privacy rights of its users and is strongly committed to protecting your privacy. Please read this Privacy Policy carefully and in its entirety. It describes what information Vista Data collects that can identify you as an individual, directly or indirectly (“Personal Information”), when you visit or use Vista Data’s website www.vistaindex.com (the “Site”) or request information from Vista Data, how Vista Data uses, shares and protects that Personal Information and the choices you have with respect to your Personal Information that Vista Data collects. By continuing to visit or use the Site, you accept the practices and policies outlined in this Privacy Policy, and you consent to Vista Data’s collection, use and sharing of your Personal Information in the manner described herein. If you do not agree with all of the provisions of this Privacy Policy, do not visit or use the Site.

Collection of Your Personal Information

Vista Data collects Personal Information from you that you voluntarily provide to Vista Data when you use the Site and when you contact Vista Data, which may include your name, address, e-mail address, password and other contact and account login information. For example, Vista Data collects Personal Information when you register to receive information from Vista Data, like the CRT Snapshot, and when you contact Vista Data to make product or support inquiries. Vista Data may also request Personal Information from you if you register for an account with Vista Data through the Site or request information.

If you are a representative of one of our paid subscribers, Vista Data may also collect your Personal Information such as your name, work title and contact details from the party you represent.

Use of Cookies And Other Electronic Tools

Vista Data may use various electronic tools, including “cookies”, to collect information and data that cannot be used to identify you personally (“Non-Personal Information”) when you visit or use the Site, including, for example, information about your computer’s IP address, browser type, language, operating system and the state from which you accessed the Site. A cookie is a small text file (up to 4KB) that is transferred to your computer’s hard drive. Most desktop and mobile web browsers are set to accept cookies by default. You can usually set your browser to disable cookies, or to alert you when cookies are being sent. The help functions on most browsers and mobile devices contain instructions on how to set your browser to notify you before accepting cookies, disable cookies entirely, or disable the collection of certain data. If you disable cookies or refuse to accept a request to place a cookie, it is possible that some parts of the Site will not function properly.

Vista Data does not respond to “Do Not Track” requests at this time.

Use and Sharing of Your Personal Information

Vista Data uses your Personal Information to communicate with you and to provide you with your requested information or support. Vista Data may also provide you with information about Vista Data’s products and services. You may instruct Vista Data not to use your Personal Information for this purpose by sending an email to VistaCRT@vistacap.com or by clicking on the “Unsubscribe” link at the bottom of an email message from Vista Data with information about products and services.

Vista Data will not share your Personal Information with third parties without your consent, except that Vista Data may share your Personal Information:

  • With Vista Data’s affiliated companies;
  • With contractors and other third parties Vista Data uses to provide and/or support the Site, including website hosting providers;
  • To comply with the law or in response to a subpoena, court order or other legal process;
  • To defend against legal claims and protect Vista Data’s rights and property;
  • To enforce Vista Data’s Terms of Use for the Site; and
  • In the event Vista Data participates in a substantial corporate transaction, such as a corporate restructuring, the purchase of another business, the sale of Vista Data’s business or a merger or consolidation with a third party.

Vista Data may collect, analyse and share Non-Personal Information (including Personal Information that has been aggregated and anonymized so that it can no longer identify you individually) from your visits to and use of the Site to identify trends and statistics that may help improve the Site, Vista Data’s products and customer service and for any other purposes that Vista Data may deem appropriate.

Security of Your Personal Information

Vista Data uses reasonable administrative, technical, personnel, and physical measures to safeguard your Personal Information against loss, theft, unauthorized use, disclosure, or modification. In particular:

  • Vista Data’s third party website hosting provider, currently WP Engine, stores your Personal Information on its remote servers, which are isolated and accessible only to WP Engine and Vista Data. To learn about the security measures provided by WP Engine, click here.
  • Vista Data enforces password strength rules for accounts through the Site and uses 2-factor authentication to enhance the security of your login ID.
  • Vista Data uses Secure Sockets Layer (SSL) encryption technology and end-to-end encryption that ensures your Personal Information is encrypted before it is sent over the internet.

To help protect your privacy, you should maintain the secrecy of the login ID and password you may have in connection with your use of the Site.

Please note that no information security practices are 100% secure or immune from circumvention. Vista Data cannot give you an absolute guarantee that your Personal Information will always be secure. If Vista Data learns of a security breach that jeopardizes or may jeopardize the security and confidentiality of your Personal Information, Vista Data will attempt to notify you electronically (subject to any applicable laws) at the email address you have provided through the Site.

Accessing and Updating Your Personal Information

At this time, Vista Data does not have a policy limiting its retention of your Personal Information and may keep it indefinitely.

To access, review, update, correct or delete your Personal Information that Vista Data has stored, please send an email to VistaCRT@vistacap.com. Vista Data will make reasonable efforts to accommodate your request. Vista Data also reserves the right to impose certain restrictions and requirements on such access requests, if allowed or required by applicable laws.

Third Party Websites

The Site and any material that Vista Data sends to you may contain links or otherwise provide access to third party websites and services. Please be aware that Vista Data has no control over the privacy policies and practices of third parties and will in no event be responsible for the privacy practices of such other websites and entities. Vista Data encourages you to be aware when you leave the Site and to read the privacy statements of each website you visit that collects Personal Information.

Vista Data reserves the right to change this Privacy Policy at any time by posting the updated Privacy Policy on this web page. Such changes will be effective seven (7) days after Vista Data provides such notice. If you object to any changes, you must cease all use of the Site. By continuing to use the Site after Vista Data publishes or communicates a notice about any changes to this Privacy Policy, you consent to those changes.

    TERMS OF USE APPLICABLE TO INDIVIDUALS AND ENTITIES ACCESSING VISTA MDX DATA

    YOU REPRESENT THAT:

    1.YOU ARE ACCESSING VISTA MDX DATA ON BEHALF OF PERSON(S) (WHICH MAY INCLUDE INDIVIDUALS, ENTITIES AND YOURSELF, ALL OF WHOM ARE JOINTLY AND SEVERALLY REFERRED TO AS THE “USER”) WHO INTEND TO USE THE INFORMATION SOLELY IN THE MANNER AND FOR THE PURPOSES PERMITTED IN THIS AGREEMENT; AND

    2. (II) YOU HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT ON BEHALF OF THE USER AND TO BIND THE USER TO THE TERMS OF THIS AGREEMENT.

    YOU ACCEPT THAT:

    1. The User acknowledges that third parties (the “Disclosing Parties”) are making certain data (the “Disclosing Parties’ Data”) available to Vista Index Services (“Vista”) for the purpose of facilitating the computation of indices (the “Index Data”) that may be used for a range of investment purposes. The User acknowledges that it has no ownership or other proprietary interest in the Disclosing Parties’ Data or the Index Data (collectively the “Vista MDX Data”).

    2. The User is permitted to retrieve, copy and use (collectively, “Use”) the Vista MDX Data solely for its internal purposes related to (i) User’s potential investment in or marketing of financial products, and (ii) research and analytics based in whole or in part on Vista MDX Data (collectively, the “Internal Purpose”). As part of the Internal Purpose, the User is permitted to Use the Vista MDX Data to: (i) derive data from Vista MDX Data; (ii) create products that incorporate Vista MDX Data or data derived therefrom (such derived data and products, “Derived Products”); and (iii) disseminate Vista MDX Data and Derived Products within the User’s organization for their Internal Purpose.

    3. The User is prohibited from using Vista MDX Data for any purpose not expressly permitted in this Agreement. Without limiting the preceding sentence, the User is prohibited from: (i) modifying or altering Vista MDX Data in any manner, except to the extent necessary for the Internal Purpose; (ii) using Vista MDX Data or any Derived Product to map data contained in these to any other data distributed by the Disclosing Parties.

    4. Except as expressly permitted under this Agreement, the User is prohibited from licensing, distributing, disclosing or otherwise making available the Asset-Level Information (in whole or in part) or any Derived Products to any third party.

    5. The Disclosing Parties have endeavoured to make the Disclosing Parties’ Data reasonably accurate but does not guarantee the Disclosing Parties’ Data are complete, error free or suitable for any particular purpose, including the Internal Purpose. Use of the Disclosing Parties’ Data is entirely at User’s own risk and Disclosing Parties will have no liability to the User or any third party for or arising out of or related to this Agreement, Disclosing Parties’ Data, Vista MDX Data, or any Derived Products. DISCLOSING PARTIES’ DATA ARE PROVIDED ON AN “AS IS”, AS AVAILABLE BASIS, AND THE DISCLOSING PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES WITH RESPECT THERETO, INCLUDING WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NO ORAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY THE DISCLOSING PARTIES OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR SUBCONTRACTORS WILL CREATE A WARRANTY.

    6. All Vista products are provided for your information purposes only, without regard to your specific investment objectives, financial situation, or particular needs, and shall not be construed as a solicitation, offer or recommendation to buy or sell any securities, investment or other financial instruments, to affect any transactions or to conclude any legal act of any kind whatsoever.

    7. Any non-licensed use of Vista MDX Data for the purpose of issuing financial instruments referencing any Vista MDX Data, entering into financial contracts or financial instruments referencing any Vista MDX Data, determining the amount payable of a financial instrument or a financial contract by referencing any Vista MDX Data or measuring the performance of an investment fund using any Vista MDX Data for the purpose of tracking the returns is expressly prohibited except as provided for under a separate license agreement from Vista.

    8. This Agreement will be governed by the laws of the State of New York, without regard to conflicts of law rules that might cause the substantive laws of another jurisdiction to govern.
